Hotel Guest Files Lawsuit for Slip and Fall Injuries

A hotel stay should be comfortable and safe for guests. One guest, however, suffered a serious fall while at the hotel and sustained injuries. The woman, a guest at the Courtyard By Marriott in Schaumburg, IL, fell as a result of alleged unsafe conditions. The lawsuit was filed in Cook County against the hotel, its parent company, and property owners, and is seeking damages of more than $50,000 from each defendant.

Slip and Fall Accidents

Slip and fall accidents can result in serious injuries. According to the CDC, about 1 out of every 5 slip and fall accidents results in a serious injury such as broken bones or head trauma. Some injuries may heal quickly while others are more severe and may require surgery and ongoing care. Serious head trauma could cause permanent disabilities or could even result in death. These types of accidents are usually preventable and are often caused by the negligence of someone else. In this case, the lawsuit claims that the hotel was negligent by allowing unsafe conditions to exist.

Unsafe Conditions Existed

The woman in this case states that she fell outside the elevator on the first floor. The floor was apparently wet or slippery and the hotel did not properly resolve the problem, allowing the accident to occur. The hotel is required to ensure that safe conditions exist. If they were aware of the problem they were negligent by failing to clean the floor and keep it safe for guests. Further, they should have known that an unsafe condition existed or could have existed and yet were negligent by failing to take action to correct it.

The property owner, or in this instance, the hotel management, is responsible for ensuring the safety of its guests. The hotel is required to make sure that the floor is kept clean and safe so that people will not fall. While the lawsuit does not state the details, you can imagine that there could be water on the floor in front of an elevator due to people walking in from outside or being wet from the pool. Whatever the reason, the hotel must properly maintain the area. Additionally, the hotel failed to place warning signs that there could be a wet or slippery surface.

Personal Injury Lawsuit

The woman in this case suffered an injury because of the negligence of the hotel. She has filed a lawsuit to seek justice in this case. The woman may be entitled to damages that include money to cover her medical bills and medication as well as any future medical treatments or rehabilitation. If she was unable to return to work for a time period because of her injury she may also request lost wages. She may also be able to recover compensation for pain and suffering as a result of the injury.
