Man Files Lawsuit after Daughter Was Struck and Killed by Motorist

Graduation celebrations should be fun and safe, yet that was not the case for one girl. While attending a party, the girl was struck and killed by a car while she crossed the road in Hoffman Estates. The girl’s father has filed a lawsuit against the driver of the vehicle, citing negligence and failure to control his car. The lawsuit was filed in Cook County and is seeking damages of more than $50,000 and legal fees.

Vehicle Accidents

Thousands of vehicle accidents occur every day in the United States. However, many of them are not serious, and there are no injuries or serious property damage. In this case, the driver of the vehicle is responsible for the accident because he failed to properly control his car. Pedestrian accidents are usually very serious, especially if the vehicle was traveling at a high rate of speed. The lawsuit in this case states that the driver was speeding, and that the driver also failed to keep a proper watch.

Control of the Vehicle

Drivers are required to keep their vehicle under control at all times. Some accidents may be attributed to poor road conditions, diminished visibility, or inclement weather, but the ultimate responsibility remains with the driver. Regardless of conditions, drivers must drive defensively. When conditions are poor, drivers need to be even more cautious, and drive more slowly. The driver in this case failed to see the girl as she was attempting to cross the street. This could indicate that the driver was negligent.

Negligent Actions

Negligent actions are those in which the person knew, or should have known, that their behavior is dangerous and could cause serious injuries. All drivers need to realize that their vehicles are inherently hazardous when they are out of control. In this instance, the driver was not paying proper attention, and was allegedly driving over the speed limit when the accident happened. The girl died from the injuries sustained in the accident.

Wrongful Death

When a person dies because of the negligence of another, this can be considered a wrongful death. The lawsuit in this case clearly blames the driver for the death of the girl, stating that the driver was negligent. In situations such as this one, the relatives of the victim may be due compensation from the responsible party. The young girl’s life was cut short because of the reckless behavior of the driver.

Sadly, cases like this one happen all too often. While no amount of money can bring the girl back, the family should not have to suffer financially because of the girl’s death. The family should be compensated for the damages caused directly because of the accident. Medical expenses, money for pain and suffering, and funeral expenses, are all items that the negligent driver should pay the family. Additionally, other damages may be paid for loss of life.
