Going to work is supposed to be safe, regardless of where you work. A tugboat crew member who works for the City of Chicago recently filed a lawsuit to recover damages caused when he was seriously injured in an accident at work. The accident happened when the man accessed a mooring line that was stuck between the boat dock and a fender. The fender had recently been installed and according to the lawsuit, was improperly positioned. The man suffered serious injuries as a result of the accident. The lawsuit seeks damages of more than $50,000.
The lawsuit claims that the companies were negligent when they installed the fender. They left the mooring line behind the fender when it should have been pulled out of the way. The improper installation caused the mooring line to be trapped behind the fender in a position where it should not have been. As a result of the negligent installation, the man was injured when he tried to dock the tugboat where he was working. This should have been an easy solution and had the mooring line been put back where it belonged before the installation was complete the entire incident could have been avoided.
In personal injury cases such as this one, the companies who were negligent are liable for any damages that were caused because of their actions. Those injured because of someone else’s negligence may be due compensation for damages that include such things as medical expenses, pain and suffering, lost wages, and rehabilitation costs. Additionally, the legal fees necessary to resolve the matter are also compensable.
Not all accidents are caused by the negligence of others. However, many accidents do occur because someone did not take the care necessary to protect the safety of others. In order to bring a lawsuit the injuries must have been caused by the negligence of another and they must be the responsible party. The failure to do something is as important as doing something incorrectly. The result is the same – negligent actions that caused injuries to another.
Thousands of injuries every year occur to people while they are at work. Unfortunately, the safety of your work environment is something that is out of your control. Your employer and others must provide a safe workplace. When a problem occurs and an accident causes injuries, the responsible party must be held accountable. In this case, the company that installed the fender did so improperly and negligently. Their negligent actions caused the injuries to the worker and therefore they are liable for any damages as a result. The lawsuit does not indicate the exact injuries to the man but does state that there was serious harm as a result. The injuries are permanent and this could mean that the man may be unable to work. Also, he may require ongoing medical treatment, surgeries, and rehabilitation therapy.
