A lawsuit was filed against a trucking company and two drivers after a fatal accident in Harvey, Il. The lawsuit alleges that the company and drivers were negligent and caused the serious accident that took the life of the passenger in the car. The lawsuit was filed on behalf of the man’s estate and cites negligence and wrongful death. The suit seeks damages in the amount of more than $50,000 and is requesting a jury trial.
The lawsuit comes after a serious fatal accident that occurred in October, 2015. The accident, occurred in Harvey, IL between a car and a truck at the intersection of 159th St. and Center Ave. The man who died was a passenger in the car. According to the lawsuit, the car and the truck, a tractor-trailer, collided with each other and the passenger died as a result of his injuries.
The lawsuit claims that the drivers of the vehicles failed to avoid the accident and neither properly kept a lookout for other vehicles. Negligence occurs when someone should have known that something they did, or failed to do, could cause serious harm or death. In this instance, the drivers are responsible because they negligently drove their vehicles, according to the lawsuit. Because of their size and weight, vehicles are dangerous. This is especially true of large tractor-trailer trucks. Drivers must be particularly cautious to prevent serious accidents from happening.
Vehicle accidents are usually caused by the negligence of one or more drivers. When a serious injury occurs, medical treatment is the first concern. Prompt medical treatment can save lives and even those who do not seem to be hurt should have a medical exam following an accident. If you are involved in an accident be sure that the police are called. When a death occurs during an accident there will usually be an accident investigation. This will help determine the exact cause of the accident and which driver was at fault. These issues will be of utmost importance later, should legal action be required.
Victims of accidents, or their beneficiaries, may be entitled to receive compensation from the responsible party. The responsible party is liable for the accident and all the injuries and expenses that resulted from it. In this case, the lawsuit states that both drivers were negligent and is therefore seeking damages from both parties. Those injured in accidents suffer a great deal of pain as well as financial hardship due to medical expenses and lost wages. A wrongful death lawsuit may also provide compensation for those left behind. For example, money may be requested to cover the children’s expenses because the person is no longer able to provide for them. These and other costs will be part of the damages sought in a lawsuit following a serious vehicle accident.
